INLAND REVENUE BOARD’S ANNOUNCEMENT – REVISED

Further to our email on 25 March 2020 pertaining to the announcement made by the Inland Revenue Board (IRB) in relation to the tax matters during the Movement Control Order (MCO) period, we are writing to inform that the IRB has issued a revised list of Frequent Asked Questions (FAQs) on 3 April 2020 following the announcement of the extension of Malaysia’s MCO period, i.e. between 18 March 2020 and 14 April 2020 [the MCO Period].  We also attach herewith the list of FAQs which was issued on 3 April 2020 for your reference.

The key changes are highlighted as follows:

Tax estimates and payments

 

  • CP204 where the statutory due date for submission falls within the MCO Period;
  • CP204A for the 6th and 9th month revision for which the statutory due date falls on 31 March 2020; and
  • CP204B where the statutory due date for submission falls within the MCO Period

  • CP204 instalment payments where the statutory due date falls on 15 April 2020

  • Submission of special revision of tax estimate in the month of the third monthly instalment that falls in the month of April 2020.
  • The deadline for the submission of revised tax estimate in the third month instalment in 2020 is based on the company’s basis period.

  • Deferment of CP204 instalment payments for 3 months beginning from April 2020 until June 2020 for all types of businesses with Small and Medium Enterprises (SMEs) status.

Definition of SME:

i.         Have a paid-up capital of not more than RM2.5 million ordinary shares at the beginning of the basis period for a year of assessment; and

ii.        Have a gross business income of not more than RM50 million.

Deferment of CP204 instalment payments will be given automatically to all SMEs based on the IRB’s records.

The deferred payments are not required to be made after June 2020.  Any balance of tax must be settled upon submission of the income tax return.

  • Deferment of CP204 instalment payments for 6 months beginning from April 2020 until September 2020 for companies that undertake activities relating to tourism
Deferment of CP204 instalment payments will be given automatically based on the IRB’s records.

The deferred payments are not required to be made after September 2020.  Any balance of tax must be settled upon submission of the income tax return.

  • Deferment of CP500 instalment payments for the month of March 2020 and May 2020
Deferment of CP500 instalment payments will be given automatically based on the IRB’s records.

The deferred payments are not required to be made after June 2020.  Any balance of tax must be settled upon submission of the income tax return.

Withholding tax
  • Where the withholding tax payment due date falls within the MCO Period
  • The payment can also be made via telegraphic transfer and the transaction details are to be submitted to the IRB via fax (03 6201 9637) or email (HelpTTpayment@hasil.gov.my).

Country-by-Country Reporting

(CbCR)

  • Deadline for Malaysian entities to file the CbCR and the constituent entities to file the notification for CbCR where the due date falls on 31 March 2020 or 30 April 2020

Employer’s obligations
  • Forms CP21, CP22, CP22A or CP22B which are required to be submitted during the MCO Period
Beginning 15 April 2020
  • Monthly Tax Deduction (MTD) for the month of March 2020 where the statutory due date falls on 15 April 2020

Tax audit or investigation
  • Submission of Documents requested by the IRB for an audit or investigation which is due during the MCO Period
30 April 2020
Tax appeals
  • Submission of Form Q which is due during the MCO Period

Form N is required to be filed by stating the delay is due to the implementation of Movement Control Order
